This $115.00/year rate for LEI is exclusive to designated Marsh Canada professional liability insurance clients and features an unlimited Legal Helpline service in addition to legal expense coverage for everyday occurrences (e.g., bodily injury due to the fault of others or employment disputes).

LEI is a special coverage that offers protection for legal expenses related to business, home, and automobile disputes. It may help pay for lawyers’ fees, disbursements for expert witnesses, medical re- ports, court costs, and adverse costs if you lose your case and a judge orders you to pay the other party’s legal fees. This is in addition to unlimited access to the ARAG Business Legal Solutions, which enables clients to ask any legal question and receive information and assistance (whether the issue is covered under the policy or not).

  • Employment Disputes: if you have a dispute with an employee arising out of their contract of employment, and/or with regards to a wrongful dismissal claim.

  • Speak to a professional counsellor concerning difficult situations that are not limited to, but may be related to any abuse such as: Psychological; Emotional; Physical; and/or Economic deprivation.

LEI is a unique product that helps individuals and business owners defend or pursue legal action if they have a dispute with another party. With the LEI coverage provided by ARAG Business Legal Solutions, policyholders have access to legal assistance and information, plus the security of knowing the costs of pursuing legal action will be covered.

Legal costs include items like lawyers’ fees, charges for disbursements and the opponent’s legal costs should you lose and be required to pay them.

If you think you may have a claim, do not ask a lawyer for advice unless ARAG has advised you to do so. If you instruct a lawyer before speaking to us, and we ultimately proceed with your claim, we are unable to honour any costs incurred before your claim was opened with us. There is also a chance that your claim could be prejudiced by not taking and following our advice from the moment you became aware of the dispute.

After reviewing your file, we assign a legal professional with the specific skills, experience and background required for your case. However, if you are unhappy with your appointed lawyer, we will work with you to agree upon another qualified person.

It is not in anyone’s best interests to support a claim which has little chance of success. In civil claims, the appointed lawyer must agree that the claim is more than likely to be successful in order for us to proceed; this is what is meant by the term “reasonable prospects.” Reasonable prospects must exist throughout the duration of a civil claim.

When you call the Legal Helpline, a helpline lawyer will discuss your situation with you and determine if you have a claim. If you do not have a claim, they will offer information on how you may resolve the issue. If you do have a claim, they will open a file for you at the end of the telephone call.

The indemnity limit shown in your policy is the maximum that would be paid out in the event of a claim. You are responsible for any costs over the indemnity limit, and we will inform you if it appears likely that this will happen.

It is often more beneficial for both parties to try and reach a settlement rather than go to court, as going to court can be stressful, expensive and time consuming. The majority of legal disputes are, in fact, settled by negotiation. The ARAG goal is to provide the most appropriate solution to your legal dispute, which may well be negotiation as opposed to going to court.

The premium is $115.00, regardless of when an applicant applies for coverage. There is no pro-rata calculation applicable for mid-term additions to the sponsored program.

How to Apply

Marsh professional liability insurance clients will be offered the opportunity to purchase LEI when they renew their existing professional liability insurance coverage online or apply for the first time.

Your offer to purchase LEI will appear on the "Limit Requested" screen of your online renewal application. Simply indicate that you want to purchase LEI for $115.00/year (plus applicable taxes) by checking the appropriate box and the cost of the insurance will be added to the premium for your professional liability insurance.
